JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-10-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Sikraul P.S. Case No. 97 of 2018, registered for the offences punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act. As per prosecution case, petitioner and co-accused Lalji Singh are said to have fired upon Birbal Mahto, brother of informant, as a result of which, he died on the spot. It is submitted by learned counsel appearing on behalf of petitioner that petitioner has falsely been implicated in this case. Petitioner is in custody since 10.12.2018. It appears that the aforesaid prosecution case is also duly corroborated by the medical report and there is direct allegation against this petitioner of firing upon the deceased.
