JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 7.8.2017 passed in Cr.Misc.No. 33674 of 2017 with liberty to the petitioner to renew his prayer for bail after framing of charge in this case.

Submission of learned counsel for the petitioner is that petitioner has remained in custody since 12.2.2017 and up till now not a single witness has been examined in this case. Heard learned APP also.

Having heard both sides and in view of allegation, I am not inclined to grant bail to the petitioner. However, since the petitioner is in custody for 10 months, learned trial court is directed to expedite the trial and try to conclude it within a period of nine months, if possible, on day

Patna High Court Cr.Misc. No.60335 of 2017 (3) dt.03-01-2018 2/2 to day basis. At the same time, the Superintendent of Police, Sitamarhi is directed to ensure the presence of the witnesses in court on the date fixed so that trial be concluded within the said period. The aforesaid directions must be strictly complied. With the above observation, this application is disposed of.
