Five witnesses have already been examined while remaining three, as the trial is proceeding ahead on day to day basis, are expected to be examined in same manner. As such, there happens to be no need to keep the file alive, more particularly over hearing for prayer of bail.

As is evident from Annexure-1, prayer for bail of petitioner had already been rejected since before, after considering the merit of the case. There happens to be no reason for reappraisal and that being so, prayer for bail is rejected. As submitted on behalf of petitioner, the trial Court is directed to proceed with the trial on day to day basis on

Patna High Court Cr.Misc. No.33898 of 2015 (06) dt.01-12-2015 having active co-operation at the end of the petitioner and will conclude the trial at an earliest, within three months. The physical appearance of the Senior Superintendent of Police, Patna is hereby dispensed with.
