JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends her arrest in connection with Patepur P.S. Case No. 55 of 2018 registered for the offences punishable under Sections 302, 201, 120-B/34 of the Indian Penal Code.

As per prosecution case, the marriage of deceased was solemnized with F.I.R. named accused Puja Devi but allegedly, the aforesaid Puja Devi had illicit relation with F.I.R. named accused Kishundeo Rai, who happens to be her brother-in-law. Petitioner is wife of aforesaid Kishundeo Rai and suspicion against her has been raised in this case.

The investigation against the petitioner has already

Patna High Court Cr.Misc. No.66185 of 2018(3) dt.17-12-2018 2/2 been completed and except suspicion, there appears to be nothing against her.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of her arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-X, Vaishali at Hajipur in Patepur P.S. Case No. 55 of 2018, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
