JUSTICE ASHUTOSH KUMAR ORAL ORDER 19-07-2019 The petitioner seeks quashing of the order dated 15.03.2019 passed by the learned Chief Judicial Magistrate, Sitamarhi in connection with G.R. No. 1850 of 2017 arising out of Bathanaha P.S. Case No. 141 of 2017, whereby cognizance has been taken against him under Sections 147, 148, 149, 307, 302, 120(B), 109, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

Patna High Court CR. MISC. No.41306 of 2019(2) dt.19-07-2019 2/2 learned Advocate for the petitioner seeks permission to withdraw this petition in order to urge all the grounds raised in the present petition at the stage of discharge.

3. Permission is accorded.

4. Should such a petition be filed before the Court below for discharge, the Court below shall take into account all aspect of the matter and shall pass order in accordance with law, without being prejudiced by the fact that the present petition has not been entertained.

5. With the aforesaid observation, the petition is permitted to be withdrawn.
