The petitioner apprehends his arrest in connection with Rajeev Nagar P.S. Case No. 95 of 2016 registered under Sections 385, 387 and 506/34 of the Indian Penal Code. Learned counsel for the petitioner submits that it would appear from the F.I.R. that informant has disclosed the name of Mantu Sharma and Sambhu Sharma and also disclosed the mobile no. 9939392355, by which, the ransom was demanded but the informant has not disclosed the name of this petitioner in the F.I.R. in any manner. The informant has also not disclosed the name of this petitioner in his statement recorded on 17.05.2016,
Patna High Court Cr.Misc. No.47087 of 2016 (3) dt.17-01-2017 under Section 164 Cr.P.C. In fact, petitioner was accused in Shastri Nagar P.S. Case No. 132 of 2016, in which, he was allowed bail but police got implicated the petitioner in the present case showing his name as associates of named accused in the restatement of informant.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Patna, in connection with Rajiv Nagar P.S. Case No.95 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
