JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 01-12-2015 Both the writ applications are disposed of at the threshold on the ground that a decision to withdraw the benefit of pay-scale has been taken against these petitioners unilaterally without giving them opportunity of hearing or notices.
If it is so and which is not a matter of dispute, the Court is willing to give opportunity to the State Bank of India to issue notices to the petitioners, seek their responses within the time-limit and then pass appropriate speaking order.
The Court would expect that notices will go to the petitioners within a month and they will have opportunity to respond to the same within the time-limit indicated in such notices. Thereafter, a speaking order will be passed within the time-frame so that the issue may rest or if such persons have further grievance, let them move the appropriate forum in this regard.
The Court has deliberately withheld itself from commenting on any of the submissions of either side because it does not want to prejudice the case of either party to the dispute. Since there was an ad interim stay granted in one of the writ applications, even otherwise, the Court is of the opinion that till a
final decision after the above exercise is completed, there may not be an occasion to make any deduction.
