The petitioner apprehends his arrest in connection with Sakara P.S. Case no. 62 of 2019, registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

The accusation is that in course of patrolling duty, informant received secret information regarding selling of liquor at Maruaha Chowk. The informant and other Police personnel reached there. On seeing the Police personnel, two persons started fleeing and left a bag there. On chase, one person was apprehended, who disclosed his name as Raju Paswan. On search, 4 bottle, each containing 750 ML India made foreign liquor recovered. The apprehended person

Patna High Court CR. MISC. No.41225 of 2019(2) dt.04-07-2019 2/2 disclosed the name of petitioner as his associate, who succeeded to flee away.

Learned counsel for the petitioner submits that petitioner has not been apprehended on the spot, rather, his name surfaced on the confessional statement of Raju Paswan. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Muzaffarpur in connection with Sakara P.S. Case No. 62 of 2019, subject to the condition as laid down under Section 438

(2) of the Cr.P.C.
