The petitioner apprehends his arrest in Beur P.S. case No. 185 of 2016 registered under Section 498(A) of the Indian Penal Code and under Section 3⁄4 of Dowry Prohibition Act. The informant made allegation that she was married to the petitioner on 25.02.2015 but after some time the petitioner and other family members of the petitioner subjected her to different sorts of torture due to non fulfillment of demand of Rs. 5 lacs as additional dowry.

The learned counsel for the petitioner submits that petitioner has earlier filed divorce case and when notice was served upon the informant she filed this case. The petitioner is still ready and willing to keep his wife.

No.791 of 2017 (2) dt.13-01-2017 2/2 Considering the willingness of the petitioner to keep his wife, the above named petitioner is directed to surrender in the court below within four weeks from today and the court below shall grant provisional bail to the petitioner for five months on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in Beur P.S. Case No. 185 of 2016.

The court below shall make all efforts for resolving the dispute between the husband and the wife. If the petitioner takes his wife and keeps her properly, the provisional bail granted to the petitioner shall be confirmed. If the petitioner fails to keep his wife properly, the court below shall pass orders on the prayer for provisional bail of the petitioner on its own merit in accordance with law.
