Petitioner seeks bail in a case registered for the offences punishable under Sections 394, 395, 397, 411, 412 and 414 of the Indian Penal Code.
The petitioner is in custody since 16.08.2017. The F.I.R. is against unknown. The petitioner was identified during Test Identification Parade. By order dated 20.02.2018, passed in Criminal Miscellaneous No.1386 of 2018, this Court had directed the court below to expedite and conclude the trial within a period of six months.
The report of the learned trial judge would reveal that only three prosecution witnesses have been examined up till
Patna High Court CR. MISC. No.65905 of 2018(3) dt.13-03-2019 2/2 now.
Submission is that petitioner is ready to fully cooperate with the trial. Considering the material and the period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Dumraon Police Station Case No.232 of 2017, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
