This application under Sections 439 and 440 of the Code of Criminal Procedure has been filed by the petitioner for grant of bail in connection with Session Trial No. 321 of 2016 arising out of Lalganj P. S. Case No. 241 of 2014 registered under Sections 498A and 307 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 16.08.2017 passed in Cr. Misc. No. 37834 of 2017.

From the report of the In-charge Sessions Judge, Vaishali, it would appear that two of the charge sheet witnesses are yet to be examined.

Considering the inordinate delay in commission of the trial, even though the prayer for bail of the petitioner was earlier rejected by this Court, he is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Vaishali at Hajipur in Session Trial No. 321 of 2016 arising out of Lalganj P. S. Case No. 241 of 2014, subject to the condition that one of the sureties must be a Government servant/elected people's representative of Panchayat/ Municipality; and the other one shall be a close relative.
