JUSTICE PURNENDU SINGH ORAL ORDER 29-10-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner apprehends his arrest in connection with Rajauli P.S. Case No. 275 of 2020, dated 24.06.2020 registered for offence punishable under Sections 30 (a), 41 and 52 of the Bihar Prohibition and Excise Act.
The informant (police officer) alleged that he got information that in the bamboo bush of Chuha Yadav @ Kishun Yadav many persons were selling liquor. As per the FIR, on complaint from Excise Bureu, Patna, informant conducted raid against liquor Mafia. On seeing the informant two persons ran away from the place of occurrence and taking advantage of the bushes. Local chaukidar have stated to the police that the
Patna High Court CR. MISC. No.40849 of 2020(2) dt.29-10-2021 2/3 persons who ran away were petitioner. From the place of occurrence 5 litres of country made Mahua wine in a gallon was recovered. The informant has found one liquor bhatti inside the bushes and also found 500 litres of jawa mahua. As per the FIR the petitioner is named accused.
Learned counsel for the petitioner submits that the informant did not disclose the name of the person, who informed him about preparation of liquor by the petitioner. Learned counsel appearing on behalf of the State opposes the prayer for grant of anticipatory bail of the petitioner.
Considering the facts and circumstances of the case and the allegation made in the FIR, this court is inclined to grant anticipatory bail to the petitioner.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the Court below within four weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. II-cum-Spl. Judge, Nawada in connection with Rajauli P.S. Case No. 275 of 2020, subject to the condition as laid down under Section 438(2) of the Code of
