The petitioner has filed the instant application for grant of regular bail in connection with Runni Saidpur P.S. Case no. 198 of 2019 registered under sections 447, 324, 307 and 34 of the Indian Penal Code and section 27 of the Arms Act. As per allegation in the F.I.R., the petitioner is stated to have fired causing injury on the chest of the informant. It is further stated that other accused persons fired causing injury on his leg.
It is submitted by learned counsel for the petitioner that the allegation so far as petitioner is concerned are false and concocted. There is no motive for the petitioner to have committed the alleged occurrence. The reason for false
Patna High Court CR. MISC. No.40858 of 2020(3) dt.09-03-2021 2/2 implication of the petitioner is land dispute between the parties. The other FIR named co-accused Jai Prakash Singh has been enlarged on bail vide order dated 02.02.2021 passed in Cr. Misc. no. 37075 of 2020. The petitioner is in custody since 11.03.2020 and the investigation in the case has concluded. He has no criminal antecedent.
The application for bail is opposed by learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner of having fired on the informant, this Court is not inclined to enlarge the petitioner on regular bail and the same is rejected. (Partha Sarthy, J) shahzad/- U T
