The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 379, 387, 504, 506/34 IPC and Section 27 of Arms Act. As per prosecution case, the allegation against the accused persons including the petitioner is that they came at the construction site of the informant and stopped him to do so. It is further alleged that while the informant was going his home in the meantime, accused persons came and started firing upon him and snatched away cash of Rs.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The informant lodged an informatory petition bearing No- 691 of 2021 dated 22.07.2021 before the C.J.M., Rohtas against the petitioner and others in which informant alleged that the petitioner and others have demanded ransom money as Rs. 35,00,000/- (thirty five lakh Rs.) but ransom demand has not been executed and due to land dispute the petitioner has falsely been implicated in this case. The FIR has been lodged after delay of about two days without given any cogent reason. It is further submitted that the petitioner is languishing in judicial custody since 13.03.2023. Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Sasaram Town Darigaon P.S. Case No. 346 of 2022 on furnishing
Patna High Court CR. MISC. No.46437 of 2023(2) dt.04-08-2023 3/3 bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Rohtas, Sasaram.
