This application is for grant of regular bail in connection with Kurtha P.S.Case No.59 of 2017 for the offences punishable under Sections 366(A)/376 of the Indian Penal Code and under Section 04 of Prevention of Children from Sexual Offences (POCSO) Act.

Allegation against the petitioner is of kidnapping the minor girl and committing rape upon her, who has supported the case in her statement recorded under Section 164 of Cr.P.C. by the girl also.

Submission of the learned counsel for the petitioner is that the witnesses have not supported the prosecution case during the trial and all the witnesses have been examined except

Heard learned A.P.P. also.

Having heard both sides and in view of facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner and if the submission is found true that only one witness has to be examined, the learned trial court is directed to expedite the trial and conclude it within a period of thee months. With the aforesaid observation, this application is disposed of.
