JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-12-2018 The petitioner seeks bail in connection with Sitamarhi P.S.Case No. 246 of 2018 registered under Sections 120B and 302 of the Indian penal Code and 27 of the Arms Act. Allegation as per FIR is that informant has received information from his aunt that his uncle has been killed and thereafter he came and found the dead body. Petitioner is not named in the FIR. Later on, his name transpired on the confessional statement of co-accused Rajoo Singh . Submission of learned counsel for the petitioner is that except confessional statement, there is nothing against the petitioner and co-accused Rajoo Singh has been granted bail by a co-ordinate Bench of this Court vide order dated 25.9.2018 passed in Cr.Misc. No. 48598 of 2018 and petitioner is in custody since 05.07.2018.

Patna High Court Cr.Misc. No.64715 of 2018(3) dt.04-12-2018 2/2 Heard learned APP also who has opposed the prayer of bail stating that the petitioner is accused in seven other cases also.

Having heard both sides and in the facts and circumstances and as other co-accused has been granted bail, let the petitioner, abovenamed, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Sitamarhi in connection with Sitamarhi P.S. Case No. 246 of 2018 with condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
