Prayer is for grant of bail in Banka (Barahat) P.S. Case No. 486 of 2017 registered under Sections 341, 323, 307, 504/34 of the Indian Penal Code.

It is alleged that the petitioner along with four others jointly assaulted the victim with lathi. The injury report suggests that he received grievous injury on the skull inasmuch as there was fracture of left parietal bone. The petitioner is in custody since 13.08.2017 having no criminal antecedent. There is a counter version also lodged by one of the co-accused of this case.

Learned counsel for the State opposes the prayer for bail. Considering the submissions made at Bar, the bail

No.52439 of 2017(2) dt.20-11-2017 2/2 application is disposed of by the following order:- Upon expiry of five months or framing of charges against the petitioner, which ever is earlier, if the petitioner furnishes the bail bonds in the sum of Rs. 10,000/- (ten thousand) with two sureties of the like amount each, the learned Court below shall accept the same and release the petitioner on bail subject to the condition that one of the bailors shall be own/close family member of the family.
