The petitioner seeks bail in Aurangabad (Mufassil) P.S. Case No. 89 of 2019, instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise (Amendment) Act, 2018.

Counsel for the petitioner submits that there is no recovery of any illicit liquor from possession of the petitioner. It is alleged in the written report that Police got information that accused persons were unloading huge quantity of illicit liquor which was to be sold by them. The informant along with other Police personnel reached the place of occurrence. On seeing the Police party, they managed to run away. In the torch light, local SHO and Chaukidar identified

Patna High Court CR. MISC. No.41045 of 2019(2) dt.09-07-2019 2/2 them. It is further alleged that 7171.2 litres of foreign liquor has been recovered from the place of occurrence.

Petitioner is in custody since 18.5.2019.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-VII cum Special Judge (Exise), Aurangabad, in connection with Aurangabad (Mufassil) P.S. Case No. 89 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
