The petitioner is in custody in a case registered for the offence punishable under Sections 454 and 380/34 of the Indian Penal Code. Chargesheet was submitted under Sections 454, 380 and 411/34 of the Indian Penal Code also. Allegedly, it is a case of committing theft of Rs.10,00,000/- cash as well as jewelry of Rs.12,00,000/- from the house of the informant in the absence of the informant and his family members.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that the stolen articles were not recovered from the conscious possession of petitioner rather recovered from another
Patna High Court CR. MISC. No.43909 of 2022(3) dt.09-01-2023 2/2 co-accused Shambhu Sah. Petitioner is in custody since 22.04.2022.
Learned APP appearing for the State has opposed the prayer for regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Vaishali P.S.
