Heard Mr. Bishnu Kant Dubey learned counsel for the petitioner and Mr. Binay Kumar Pandey, learned A.C. to G.P.2 for the State.

In the nature of order this Court proposes to pass it would not require to delve into merits of this case. Suffice it to say that the petitioner is aggrieved by the order bearing no. 1282 of 2015 passed by the Superintendent of Police, Railway bearing Memo No. 2476 dated 26.10.2012 which arises out of a departmental proceeding bearing No. 1 of 2015 whereby the petitioner has been visited with a

Patna High Court CWJC No.151 of 2016 dt.05-09-2016 2/2 punishment of reduction in pay scale to the basic pay of Rs. 5880/- +2000/- (Grade pay) resulting in monetary loss of Rs.14770/- per month which order of reduction is to be valid for next 5 years. Mr. Dubey learned counsel for the petitioner informs that the order of the Superintendent of Police has been affirmed by the Appellate Authority vide order bearing No. 142 dated 14.10.2016 placed on record vide Annexure-18 to I.A.No.697 of 2016 and against which the petitioner has preferred a memorial before the Director General of Police on 19.2.2016, a copy of which is placed at Annexure-19 to the said interlocutory application. For the present the only prayer made by Mr. Dubey learned counsel appearing for the petitioner is for appropriate direction to the Director General of Police to consider the memorial and for its disposal in accordance with law. The prayer so made by the petitioner cannot be objected to by Mr. Pandey learned State counsel who admits to the submissions.

Having heard counsel for the parties, this writ petition and the interlocutory application are disposed of with the direction to the Director General of Police, Bihar, Patna to consider the memorial preferred by the petitioner, a copy of which is placed on record vide Annexure-19 to the interlocutory application and dispose of the same in accordance with law expeditiously and preferably within three months from the date of receipt/production of a copy of this order.
