JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-11-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Ayar P.S. Case No. 2 of 2016 dated 8.1.2016 for the offences punishable under Sections 392 of the Indian Penal Code. The case of the prosecution is that one Pappu Kumar gave a written report to the police that while the informant was coming on his motorcycle, the petitioner along with other accused persons surrounded him and looted the motorcycle. The learned counsel for the petitioner submits that the petitioner is innocent and the FIR was lodged against unknown persons although the petitioner is said to be the neigbour of the informant. It is further submitted that no recovery has been made from the petitioner.

Considering the criminal antecedent of the petitioner,

Patna High Court Cr.Misc. No.53201 of 2017 (2) dt.09-11-2017 2/2 I deem it fit and proper to enlarge the petitioner on regular bail on completion of nine months of his custody from the date of his arrest i.e. 18.05.2017, on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M., VII Bhojpur at Ara, in connection with Ayar P.S. Case No. 2 of 2016 and also subject to other terms and conditions as may be deemed fit and proper by the learned trial court.
