JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-11-2018 Petitioner prays for bail in connection with Kotwali (Tilkamanjhi) P.S. Case No. 301 of 2018 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Allegation against the petitioner, who happens to be husband of the deceased, is of causing death of the deceased. Submission of learned counsel for the petitioner is that she has committed suicide and charge sheet has been submitted in this case under Section 306 IPC and the statement of witnesses during course of investigation shows that she has committed suicide and petitioner is in custody since 10.5.2018. Heard learned APP also, who has opposed the prayer for bail stating that some witnesses have stated that petitioner
Patna High Court Cr.Misc. No.65339 of 2018(3) dt.30-11-2018 2/2 and others have killed the deceased and dead body was found in hanging position.
Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali (Tilkamanjhi) P.S.Case No. 301 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
