The petitioners are apprehending their arrest in connection with Nauhatta P.S. Case No. 65 of 2014 for the offences instituted under Sections 147, 148, 149, 307, 353, 224, 225, 341, 323 and 414 of the Indian Penal Code. The allegation against the petitioners is of committing loot of the vehicle from the lawful custody of the police force and they were adamant to assault the informant and other police personnel and also pelted bricks and stone on the police

It has been submitted on behalf of the petitioners that the petitioners have falsely been implicated in the present case. They have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. General and omnibus allegation has been made against the petitioners. No specific overt act has been alleged against the petitioners. None is said to have been injured in course of occurrence. On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Nauhatta P.S. Case No. 65 of 2014 on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Saharsa, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
