JUSTICE ARUN KUMAR ORAL ORDER 20-12-2017 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Panapur P.S.Case No. 83 of 2016 registered under Sections 147, 148, 149, 341, 323 and 302 of the Indian penal Code. Allegation in brief is that due to dispute of a tree, petitioner along with others caught hold hands and feet of the deceased and Sonu Rai gave a Farsa blow over his head as a result of which he succumbed to injury while on way to hospital. Learned counsel for the petitioner submits that due to enmity, petitioner has been falsely implicated in this case and there is no specific allegation of assaulting the deceased by the petitioner which is against one Sonu Rai and similarly situated coaccused Ambika Rai has already been granted bail by a coordinate Bench of this Court vide order dated 26.04.2017 in Cr.

Patna High Court Cr.Misc. No.61203 of 2017 (2) dt.20-12-2017 2/2 Misc. No. 7663 of 2017 and the petitioner is in custody since 12.07.2017 and charge sheet too has been submitted. Having considered the aforesaid facts and circumstances, the petitioner, namely , Harendra Rai is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-11, Saran in connection with S.T. No. 679 of 2016 arising out Panapur P.S.Case No. 83 of 2016 (Arun Kumar, J) Sujit/- U T
