JUSTICE SANJAY PRIYA ORAL ORDER 3/ 29-08-2019 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Pandarak P.S. Case No.21 of 2019 instituted for the offence under Section(s) 302, 201/34 Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the First Information Report.

In the written report, it is alleged that brother of the informant got traceless. The informant enquired from his Bhabho, who told that he has gone to Delhi to earn livelihood. It is alleged that on 01.03.2019, informant got information that some bones have been recovered from the house of Nikki Devi. Thereafter, bones, belt, underwear etc. were recovered by the police in presence of witnesses. The informant has raised

Patna High Court CR. MISC. No.40113 of 2019(3) dt.29-08-2019 2/2 suspicion against Nikki Devi and Chandrashekhar for committing murder of the deceased because Nikki Devi had illicit relation with Chandrashekhar.

During investigation, co-accused, Chandrashekhar, has given confessional statement in which he has disclosed name of this petitioner.

Petitioner is in custody since 30.04.2019.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 1st, Barh, Patna, in connection with Pandarak P.S.
