05-09-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offence under Sections 346, 367, 372, 373, 506 of the Indian Penal Code and Sections 3, 4, 5, 6 of Immoral Traffic (Prevention) Act, 1956.

3. As per the prosecution case, this petitioner, being organizer of orchestra, used to bring minor girls for the purpose of prostitution in guise of orchestra. It is further alleged that when a raid was conducted by informant & other police party, the petitioner succeeded in fleeing away from the place of occurrence, but one minor girl and one person were apprehended there.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. He has

During course of investigation, the apprehended minor girl (victim) was examined and in the statement recorded under Section 164 Cr.P.C., she has denied the prosecution case and has stated that she was brought to Motihari to take part in dance programme for earning by coaccused Vishwajeet, with whom, she has already married. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Harsidhi P.S. Case No. 193 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay U T
