JUSTICE ARUN KUMAR ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Section 366/120(B) of the Indian Penal Code.
Allegation in brief is that this petitioner has taken away 20 years old son of the informant to Delhi to engage in some contract work and when she called on mobile to the petitioner, another accused Rohit Mandal informed that her son had escaped from Anand Bihar Station.
It is submitted that there is no allegation of kidnapping. The informant's son was not mentally sound as his uncle in para-8 of the case diary has stated so; on the way, he had escaped away and this petitioner has no criminal antecedent except
Patna High Court Cr.Misc. No.539 of 2017 (3) dt.10-02-2017 2/2 one under Section 395 of the I.P.C. in which he was not named in the F.I.R.
Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Kumud Kumar Mandal @ Kumod Kumar Mandal be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Katihar in connection with Falka (Pothia) P.S. Case No.99 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
However, he will appear before the investigating agency and report twice on Monday and Friday in each week and co-operate with the police in investigation and in case of not turning up, the court below shall cancel his bail bond. (Arun Kumar, J) N.H./- U T
