JUSTICE ANIL KUMAR SINHA ORAL ORDER 26-03-2021 Heard Mr. Ashok Kumar, learned counsel for the petitioner and Mr. Tarkeshwar Nath Thakur, learned Additional Public Prosecutor appearing for the State. Petitioner seeks regular bail in connection with Nayagawn P.S. Case No. 58 of 2019 registered for the offences punishable under Sections 25(1-B)a, 26 and 35 of the Arms Act.

The allegation as per the First Information Report is that the petitioner along with other co-accused persons was intercepted by the Police and upon query, the petitioner disclosed that he is absconder and is wanted in four cases of loot etc. It has further been alleged that at the instance of

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case with oblique motive. Learned counsel further submits that no firearm has been recovered from conscious possession of the petitioner. Learned counsel referring to paragraph-3 of the bail petition submits that in all three cases, the petitioner is on bail. Learned counsel next submits that the petitioner is in custody since 6.11.2019 and charge sheet has already been submitted in the matter.

Having regard to the submissions made by the parties and taking into consideration the materials on record and the fact that the petitioner is in custody since 6.11.2019 as well as charge sheet has already been submitted in the matter, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.20,000/- (Twenty thousand) each with two sureties of the like amount each to the satisfaction of Shri Ravi Ranjan, learned Judicial Magistrate, 1st Class, Begusarai, in
