Petitioner seeks bail in Sessions Trial No.494 of 2018 arising out of Rajiv Nagar P.S. Case No.230 of 2017 instituted for the offence under Section(s) 395 Indian Penal Code. Counsel for the petitioner submits that petitioner is not named in the written report. No Test Identification Parade has been held. No incriminating article has been recovered from possession of the petitioner. Name of the petitioner has come in the confessional statement of co-accused, Indal Rai. Police on the basis of aforesaid confession has arrested the petitioner in connection with Rajiv Nagar P.S. Case No.235 of 2017 and, thereafter, remanded in this case.

Patna High Court Cr.Misc. No.72581 of 2018(2) dt.06-12-2018 2/2 accused, Indal Rai, has already been granted regular bail by coordinate Bench of this Court by order dated 16.08.2018 passed in Cr. Misc. No.30398 of 2018.

Petitioner is in custody since 09.04.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ADJ-VI, Patna, in connection with Sessions Trial No.494 of 2018 arising out of Rajiv Nagar P.S.
