JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-12-2014 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with L.N.M.U. P.S. Case No. 145 of 2012 registered for the offences punishable under Sections 364, 511/34 of the Indian Penal Code and 25(1-b), 35 of the Arms Act.
Petitioner is not named in the first information report but in course of investigation, co-accused, Ahmad Reza was arrested and made his confessional statement in which the said accused disclosed that this petitioner provided his Scorpio vehicle for committing the instant crime.
Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to
Patna High Court Cr.Misc. No.48533 of 2012 (3) dt.23-12-2014 grant the privilege of anticipatory bail to the petitioner and accordingly, his prayer for anticipatory bail stands rejected. However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner, if petitioner surrenders before the concerned court within six weeks from today and seeks regular bail.
