====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 12-07-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 30(A), 32, 36 and 41 of the Bihar Prohibition and Excise (Amendment) Act.

Learned counsel for the petitioner submits that petitioner has moved this Court earlier seeking anticipatory bail and the same was permitted to be withdrawn by order dated 10.05.2023 in Cr. Misc. No. 17804 of 2023.

Considering the fact that petitioner initially had withdrawn the anticipatory bail application and has again moved second time for seeking the same relief, the Court is not inclined to entertain the second anticipatory bail application in connection with Musrigharari P.S. Case No. 09 of 2023 pending

Patna High Court CR. MISC. No.44247 of 2023(2) dt.12-07-2023 2/2 in the Court of learned Special Excise Judge-I, Samastipur/successor Court.

Accordingly, the prayer for anticipatory bail is rejected.
