The petitioner is apprehending his arrest in connection with Brahampur (Chakki O.P.) P.S. Case No. 779 of 2022 for the offence under sections 147, 148, 149, 447, 341, 232, 307, 427, 504 of the I.P.C. and section 27 of the Arms Act later on sections 337, 338 and 302 of I.P.C. was added lodged on 02.11.2022 by the informant, Gopal Yadav.

As per the prosecution story, the accused persons started indiscriminate firing and against Raju Yadav, it is alleged that he opened fire causing injury in the abdomen of the Awadhesh Yadav. Accordingly, the F.I.R.

The case of the petitioner is that omnibus allegations are there and specific allegation is against Raju Yadav .

No.45594 of 2023(2) dt.04-08-2023 2/2 On the other hand, learned counsel for the informant submits that processes under Section 82 of the Cr.P.C. stands initiated and further, he has number of cases under his belt. Considering the kind of allegation that has come against the petitioner as also that he has criminal antecedent as per paragraph 3, this Court is not inclined to extend him the privilege of anticipatory bail, which is accordingly rejected.
