2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 137 (2), 140 (3) of the Bhartiya Nyaya Sanhita, 2023.
3. The case of the prosecution is that son of the informant was kidnapped by the petitioner and others and later on he was killed.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that in this case, the petitioner and one Niwas Singh has given their confessional statement and from the confessional statement, it is

It has been further argued by the learned counsel for the petitioner that the daughter of Niwas Singh was married but after marriage, this petitioner has made video viral and this was the motive why he was being kidnapped. From perusal of the confessional statement which is at paragraph nos. 45 and 46 of the case diary, it is clear that the dead body was recovered on the disclosure of confessional statement of this petitioner. It is further submitted that period of custody of this petitioner and Niwas Singh differs. Moreover, the petitioner is languishing in judicial custody since 21.07.2024.

Learned APP appearing for the state has opposed the prayer of regular bail stating that the bail of the similarly situated accused, namely, Niwas Singh has been rejected by a co-ordinate Bench of this Court vide order dated 12.05.2025 passed in Cr. Misc. No. 18868 of 2025. He further submits that period of custody cannot be a ground of bail.
6. Considering the aforesaid facts and circumstances of the case and maintaining the unanimity with Cr. Misc. No. 18868 of 2025, I am not inclined to extend him the privilege of bail which is accordingly rejected.

7. However, the petitioner will be at liberty to renew his prayer for bail after six months, if the trial is not concluded. (Ashok Kumar Pandey, J) Jagdish/- U T
