1. This application, for grant of anticipatory bail, arises out of Baunsi Police Station Case No. 96 of 2023, dated 19.05.2023, disclosing offences punishable under Sections 341/323/354-B/420/506/504/34 of the Indian Penal Code.

2. The prosecution case, as per the First Information Report, is that the petitioner, along with other co-accused persons, claiming themselves to be the owner of the C.S.P., got the account opened of the informant in the C.S.P. and misused her account for illegal purpose and the transaction of Rs. 12,05,778/- was done from the said account, as informed to the informant by the Police.

3. Learned Counsel for the petitioner submits that the

Patna High Court CR. MISC. No.49484 of 2024(2) dt.21-08-2024 2/2 petitioner is not the owner of the C.S.P. and is a covillager of the informant and due to village rivalry, he has been made accused in the present case.

4. I have heard learned Counsel for the parties concerned.

5. From perusal of the First Information Report and other materials, including the impugned order, it appears that the petitioner, along with other co-accused persons, allured the informant, opened the account in the C.S.P. for the purpose of receiving the benefit under MANREGA and other Government schemes. The informant, being an innocent lady, got the account opened in the C.S.P. run by the co-accused Amit Kumar Singh and her account was misused by the accused persons.

6. The bank fraud is common now-a-days and is run by a gang. Accordingly, I am not inclined to grant the petitioner privilege of anticipatory bail.
