The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 379/411, 120B of the Indian Penal Code, 4/44 of Mines and Mineral (Development & Regulation) Act and 33, 41, 42, 51 and 52 of the Indian Forest Act.
The prosecution case is that a truck met with an accident loaded with stones chips when it was found that the stones were illegally mined from Fazilpur protected forest. The petitioners are owner and the driver of the vehicle in
Patna High Court Cr.Misc. No.55354 of 2015 (2) dt.14-12-2015 2/2 question.
It is submitted by learned counsel for the petitioners that the stones were transported on valid challans but the same were not considered, on suspicion the accusation has been levelled and for which confiscation proceeding has already been started.
The aforesaid facts may constitute ground for consideration of prayer for regular bail, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Bikramganj P.S. Case No. 141 of 2015 pending in the court of learned Additional Chief Judicial Magistrate, Bikramganj, Rohtas.
