2. The petitioner seeks bail in connection with Gopalpur P.S. Case No. 132 of 2023 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2018.

3. As per the prosecution case, 27 litres of illicit liquor was recovered from the gunny bag which was loaded on the cycle of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is in jail since

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-IV-cum- Special Excise Court No. II, Gopalganj/ concerned Court in connection with Gopalpur P.S. Case No. 132 of 2023.

7. The petitioner will also mark attendance in Gopalpur Police Station, Gopalganj on the first and third Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.
