KUMAR ORAL ORDER 16-01-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with Shamho P.S. Case No. 18 of 2017 registered for the offence punishable under Sections 25(1-b)a, and 26 of the Arms Act.

The informant is a Sub-Inspector of police and he had stated that he received a secret information that one person is roaming with pistol, on such information he reached there but seeing the police personnel accused person started fleeing and thereafter he was caught hold. On search one loaded country made pistol and 17 live cartridges have been recovered from his possession.

Patna High Court Cr.Misc. No.60731 of 2017 (3) dt.16-01-2018 2/2 Learned counsel for the petitioner submitted that the petitioner is quite innocent and has been falsely implicated in this case. It has further been submitted that when the police arrested him he was in the house and from perusal of the FIR it has been said by the police himself that same has been recovered from the "Lungi". It has further been submitted that he is a poor man and only bread earner in his family and he is in custody since 29.07.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Begusarai, in connection with Shamho P.S. Case No. 18 of 2017. (S. Kumar, J) veena/- U T
