JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-12-2015 Petitioners being parents, brothers and brothers' wives of the husband of the informant are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 342, 323, 324, 307, 380, 448, 504/34 of the Indian Penal Code. Subsequently Section 498A I.P.C was also added.
The accusation is of making assault to the informant and committing theft of jewellery, mobile and other articles worth rupees three lacs.
It is submitted by learned counsel for the petitioners that accusation is omnibus and general and earlier also the informant filed a case with accusation under Section
Patna High Court Cr.Misc. No.56050 of 2015 (2) dt.10-12-2015 2/2 498A I.P.C which ended into compromise and thereafter the present case with malicious accusation has been filed. Considering the omnibus and general accusation against the entire in-laws family and thrust of accusation against the husband of the informant, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Motihari Mufassil P.S. Case No. 283 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
