JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-10-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Phulwari Sharif (Gaurichak) P.S. Case No. 128 of 2002, G.R. No. 1075 of 2002 corresponding to Sessions Trial No. 152(A) of 2005, registered for the offence punishable under Sections 302, 201 and 34 of the Indian Penal Code and section 27 of the Arms Act. Petitioner is step brother of the informant. Petitioner is alleged to have fired on the chest of informant's father, as a result of which, he fell down and thereafter petitioner along with other co-accused threw his dead-body near fire. In view of the fact that the case is of the year 2002 and seventeen years has already been elapsed and, therefore, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
