The petitioner is apprehending arrest in a case registered for the offences punishable under sections 363 and 366A of the Indian Penal Code.
The accusation is of abducting the minor daughter of the informant.
It is submitted by the learned counsel for the petitioner that the victim in 164 Cr.P.C. statement got her age recorded as 20 years when the court assessed her age as 16 years where the victim stated that she of her own married with the petitioner and wants to reside with him.
The doctor assessed the age of the victim between fifteen to sixteen years.
Patna High Court Cr.Misc. No.55314 of 2015 (2) dt.07-12-2015 2/2 Considering the 164 Cr.P.C. statement of the victim, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Bathnaha P.S. Case No. 260 of 2014 pending in the court of learned CJM, Sitamarhi.
This application is disposed of with the aforesaid observation/direction.
