Earlier, the prayer for bail of the petitioner was rejected giving liberty to the petitioner to renew his prayer for bail if his trial is not concluded within four months from the date of receipt/ production of copy of the order dated 18.04.2016 passed in Cr. Misc. No. 15361 of 2016 in the trial court. The trial court has reported that up till now, the trial of the petitioner is pending and it appears from perusal of the report of the trial court that not a single prosecution witness could be examined.

Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody since

Patna High Court Cr.Misc. No.47457 of 2016 (3) dt.18-01-2017 2/2 10.11.2015 and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Learned Munsif-II cum Judicial Magistrate, 1st class, Sasaram, Rohtas in connection with trail no. 66 of 2016 arising out of Sasaram( Model) P.S.Case No. 1253 of 2015.
