JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504 and 506 of the Indian Penal Code, Section 27 of the Arms Act and Section 2(V) of the SC/ST (Prevention of Atrocities) Act. The prosecution case is that the informant being a cleaner in the NGO school was cooking when the accused persons threw bottle and on protest being made the petitioner caused firearm injury and abused the informant by calling caste name. It is submitted by learned counsel for the petitioner that the injury report suggests injury caused by penetrating object and hard and blunt substance simple in nature. The Land Case No. 149/2014-15 is going on between the parties from before. For the occurrence of 10.09.2015, the FIR was lodged on 13.09.2015.

No.55665 of 2015 (2) dt.08-12-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Patna in connection with Digha P.S. Case No. 287 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
