2. The petitioner seeks bail in connection with Sanokhar P.S. Case No. 45 of 2025registered for the offence punishable under Sections 65(1), 87 and 137(2) of the Bharatiya Nyaya Sanhita.

3. As per the prosecution case, the petitioner is accused of kidnapping the victim girl.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. Petitioner is in custody since 05.04.2025. He further submits that the victim in her statement has not supported the case of the prosecution.

5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

6. Considering the statement of the victim girl, it appears that she has eloped with the petitioner, this application is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Court of POCSO-cumDistrict & Additional Sessions Judge-VII, Bhagalpur/ concerned Court below in connection with Sanokhar P.S. Case No. 45 of 2025.

8. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not express any opinion on the merits of the case.
