The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 413, 414, 420/34 of the Indian Penal Code and 47(a) of the Excise Act.

Huge quantity of country made liquor were seized from the truck in question.

It is submitted by learned counsel for the petitioner that the petitioner is the owner of the truck whereas the Cleaner of the truck, namely, Prabhu Kamti was apprehended on spot, who disclosed the name of the driver as Md. Amzad. It is further submitted that the seized country made

No.56160 of 2015 (2) dt.10-12-2015 2/2 liquor was belongs to one Deepak Kumar Gupta, who carrying the same on valid paper, and the certificate to that effect has been sent by the Superintendent of Excise, Darbhanga vide letter No. 3077 dated 14.10.2015 to the learned court below. The truck has also released in favour of the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Darbhanga in connection with Sakatpur P.S. Case No. 63 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
