JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-12-2015 Heard learned counsels for the petitioner and the State. The petitioner being husband of the complainant is apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code. The basic accusation is of torture.
It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the complainant in 2009. The complainant filed two cases with similar accusation being Khagaria P.S. Case No. 355 of 2011 and the present complaint. The petitioner has been granted bail in Khagaria P.S. Case No. 355 of 2011 vide Cr. Misc. No. 18995 of 2015 after remaining in custody for about nine months. It is further
Patna High Court Cr.Misc. No.55633 of 2015 (2) dt.08-12-2015 2/2 submitted that the petitioner is still ready to keep the complainant as wife with due dignity and honour though statement to that effect has not been made in the petition.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Bhagalpur in connection with Complaint Case No. 374 of 2011 subject to the conditions as laid down under Section 438(2) Cr.P.C.
