The petitioner seeks regular bail in connection with Baheri P. S. Case No. 144 of 2017 (G.O. No. 1387 of 2017) instituted for the offence punishable under Section 30 (a) of the Bihar Excise Prohibition Amendment Act, 2016. The allegation against the petitioner is regarding recovery of 146 liters of foreign liquor from the Shiv Mandir pond.
Learned counsel for the petitioner submits that there is no material on record to connect the petitioner with the alleged occurrence and the petitioner has clean antecedent and he is in custody since 02.11.2017.
Patna High Court Cr.Misc. No.59246 of 2017 (2) dt.22-12-2017 2/2 Considering the nature of accusation, period of custody undergone and clean antecedent, the petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-IV -cum- Special Judge ( Excise), Darbhanga in connection with G.O.
