JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 The petitioner seeks regular bail in connection with Arwal P.S. Case No. 261 of 2014, registered for offences punishable under Sections 414, 467, 471, 468, 120(B) of the Indian Penal Code and Section 47(a) of Excise Act. Allegation as per F.I.R that police on information that a truck loaded with illegal articles coming towards patna, on which, a raiding party was constituted and checking was started on N.H. 98 and during the course of checking, police intercepted the truck and petitioner and co-accused started fleeing away but were caught on chase. Further on search of the truck, 1570 cartoon liquor, in which, each cartoon had 48 bottles and each bottle containing 180 M.L. of liquor. It further appears that petitioner is an accused in one more case.

No.67074 of 2018(3) dt.21-12-2018 2/2 It has been submitted on behalf of the petitioner that he has been in judicial custody for last four years and other coaccused, who has handed over the truck to the petitioner has already been enlarged on bail by a coordinate Bench of this Court vide order dated 07.09.2015 passed in Cr. Misc. No. 36116 of 2015.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 02nd Additional Sessions Judge, Jehanabad, in connection with Arwal P.S. Case No. 261 of 2014, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
