The petitioner apprehends her arrest in a case registered for offences punishable under Section 304(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is mother-in-law of the deceased and the husband of the deceased has already surrendered on 25.06.2016 and he is in jail. It is further submitted that the victim's statement was recorded by the police in which she has taken the name of her husband only for the occurrence of burning her and the name of the petitioner taken by the informant is an afterthought. It is lastly contended that petitioner is a lady of advanced age.

No.37858 of 2016 (2) dt.20-09-2016 2 / 2 Having regard to the facts and circumstances of the case and also the fact that the petitioner is a lady, let the above named petitioner be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Vaishali Sadar Mahila P.S. Case No. 19 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of S.D.J.M., Hazipur subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
