2. The petitioner apprehends his arrest in a case registered for the offence under Section 17(a), 18(a), 21(a), 29 of the N.D.P.S. Act.

3. Five small pouch of Smack (weighing about 560 mg) has been recovered from the possession of co-accused Md. Javed, who was apprehended on spot, and he disclosed the name of this petitioner, as his associate, who fled away from spot.

4. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case. No incriminating article has been recovered from the possession of this petitioner. Petitioner has got clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge (NDPS Act), Kishanganj in connection with Special Case No. 20A of 2023, arising out of Bahadurganj P.S. Case No. 38 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
