JUSTICE SANJAY PRIYA ORAL ORDER 20-12-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Saharsa Sadar P.S. Case No. 656 of 2016 instituted for the offence under Sections-307, 326, 504, 341/34 of the Indian Penal Code and 27 of the Arms Act. Earlier prayer for bail of the petitioner was rejected by this court vide order dated 27-01-2017 passed in Cr. Misc. No. 52997 of 2016.

Counsel for the petitioner has submitted that the petitioner is in custody since 23-08-2016.

Allegation against this petitioner is that he fired from the pistol which hit on the face of the informant causing injury in the jaw.

The report has been received from the court below from

Patna High Court Cr.Misc. No.55478 of 2017 (3) dt.20-12-2017 which it appears that the case has yet not been committed to the court of Sessions.

In such circumstances, keeping in view the period spent by the petitioner in custody and the fact that uptill now, case has not been committed to the court of Sessions, prayer for bail is allowed. The petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each in connection with Saharsa Sadar P.S. Case No. 656 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Saharsa with condition that both the bailors should be close relatives of the petitioner. The petitioner will cooperate in the trial and will not attempt to tamper the witnesses or delay the trial otherwise bail bond will liable to be cancelled. (Sanjay Priya, J) A.K.V./- U T
